Vortix Global Dynamics LLC (“Vortix”, “we”, “us” or “our”) provides enterprise cloud infrastructure and systems engineering services to business clients. This Privacy Policy explains what personal information we collect through vortixglobaldynamics.com and in the course of delivering our services, how we use and protect it, who we share it with, and the rights you hold over it.
We ask you to read this policy in full. If any part of it is unclear, contact us at contact@vortixglobaldynamics.com and we will explain it.
1. Scope of this policy
This policy applies to personal information we process as a data controller — that is, information we collect for our own purposes, such as inquiries submitted through this website, communications with prospective and current clients, and records we are required to retain for legal and tax purposes.
Where we process data inside a client’s own cloud environment while delivering engineering services, we act as a data processor on that client’s written instructions. Those activities are governed by the data processing agreement in the relevant engagement contract, not by this policy.
2. Information we collect
2.1 Information you provide directly
When you complete the consultation form on this website or contact us by email or telephone, we collect:
- Identity data — your full name and the name of the company you represent.
- Contact data — your business email address and the telephone number you provide.
- Inquiry content — the description of your infrastructure requirement and any further detail you choose to send us.
- Consent records — whether you affirmatively opted in to receive SMS communications, the exact wording of the consent statement you were shown, and the date and time of that action. We retain this record specifically so that consent can be evidenced if questioned.
2.2 Information collected automatically
Our hosting provider records standard server and edge-network telemetry for security and availability purposes, including IP address, user agent string, requested URL, response status and timestamp. These logs are used to detect abuse and diagnose faults. We do not use them to build advertising or behavioural profiles.
2.3 Information we do not collect
We do not knowingly collect special category data (such as health, biometric, racial, religious or political information), payment card numbers through this website, or government identity numbers. Please do not include such information in a form submission.
3. How we use information
We use personal information only for the purposes set out below:
- To respond to your inquiry and to prepare and discuss a proposal or statement of work.
- To deliver contracted services, including sending transactional notifications about engagement status, scheduled maintenance and production incidents.
- To provide technical support and to keep a record of support correspondence.
- To operate, secure and improve this website and our internal systems.
- To meet our legal, accounting and regulatory obligations, and to establish, exercise or defend legal claims.
We do not sell personal information, and we do not share it with third parties for their own marketing purposes. We do not engage in cross-context behavioural advertising.
4. Mobile communications & SMS
Mobile Communications & SMS Privacy Policy
“No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.”
4.1 How we obtain consent
We send SMS messages only to individuals who have given express written consent by ticking the consent checkbox on the consultation form of this website. That checkbox is unchecked by default and must be affirmatively selected; it is never pre-selected, and consent is never inferred from any other action. Providing a mobile number alone does not constitute consent.
4.2 What we send
Our messaging programme is transactional and support-related only. Messages may include acknowledgement of an inquiry, engagement and scheduling updates, infrastructure incident and maintenance alerts, and direct replies from our support team. Message frequency varies according to your support activity and the status of your engagement. We do not send marketing or promotional SMS.
4.3 Opting out
You may withdraw consent at any time by replying STOP to any message from us. Your number is suppressed immediately and you will receive a single confirmation message. Consent to receive messages is not a condition of purchasing any product or service.
4.4 Handling of mobile data
Mobile telephone numbers and the associated opt-in records are stored separately from our general marketing systems and are accessible only to personnel who need them to operate the messaging programme. They are transmitted to our messaging carrier and aggregator solely for the technical purpose of delivering the messages you have requested, under contracts that prohibit any secondary use. They are never sold, rented, leased, or disclosed to affiliates or third parties for marketing or promotional purposes.
5. Legal bases for processing
Where the EU or UK General Data Protection Regulation applies, we rely on the following legal bases:
- Consent — for SMS communications, and for any optional cookies should we introduce them. You may withdraw consent at any time.
- Performance of a contract — to deliver services you have engaged us for and to take steps at your request before entering a contract.
- Legitimate interests — to secure our website and systems, to respond to business inquiries, and to keep records of our commercial relationships, balanced against your rights and freedoms.
- Legal obligation — to retain accounting records and to respond to lawful requests from public authorities.
6. Cookies & similar technologies
This website is a static site and does not set advertising, analytics or cross-site tracking cookies. We do not deploy third-party trackers, advertising pixels, session recording or fingerprinting technologies.
Our content delivery network may set a strictly necessary cookie to route requests and mitigate denial-of-service attacks. Strictly necessary cookies are exempt from consent requirements because the service cannot be delivered without them. If we later introduce optional analytics, we will present a consent banner and update this section before any such technology is enabled.
Your browser can be configured to block or delete cookies. Doing so will not prevent you from using this website.
7. How we share information
We disclose personal information only in the limited circumstances below, and only to the extent necessary:
- Service providers — vetted vendors who process data on our behalf under written contract, including our cloud hosting provider, email delivery provider, messaging aggregator and accounting software. They may use the data only to provide services to us.
- Professional advisers — legal, insurance and accounting advisers where necessary and subject to professional confidentiality obligations.
- Legal and safety requirements — where disclosure is required by law, court order or valid legal process, or where necessary to protect our rights, property or the safety of any person.
- Corporate transactions — in connection with a merger, acquisition or transfer of assets, subject to the acquirer honouring this policy. We will notify affected individuals of any change in controller.
As stated in Section 4, mobile information and SMS opt-in consent data are excluded from all of the sharing categories above insofar as marketing or promotional use is concerned, and are never shared with third parties for those purposes.
8. Data retention
We retain personal information only as long as there is a defined reason to hold it:
- Unsuccessful inquiries — retained for 24 months from last contact, then deleted.
- Client engagement records — retained for the duration of the engagement and for seven years thereafter, to satisfy contractual, tax and limitation-period requirements.
- SMS consent and opt-out records — retained for at least four years after the consent is withdrawn, because we are required to be able to evidence both the grant and the revocation of consent.
- Server and security logs — retained for 90 days.
9. Data security
We apply the same controls to our own systems that we implement for clients. These include encryption in transit using TLS 1.2 or higher, encryption at rest using provider-managed keys, role-based access control on a least-privilege basis, mandatory multi-factor authentication for all personnel, short-lived credentials in place of standing administrative access, centralised audit logging, and formal vendor review before any processor is engaged.
No system is perfectly secure. If we become aware of a breach affecting your personal information, we will notify you and the relevant supervisory authority where required by law and within the applicable statutory deadline.
10. Your privacy rights
10.1 Rights under the GDPR (EEA and UK residents)
- Access — obtain confirmation of processing and a copy of your data.
- Rectification — have inaccurate or incomplete data corrected.
- Erasure — request deletion where we have no overriding lawful basis to retain.
- Restriction — request that we limit processing in defined circumstances.
- Portability — receive your data in a structured, machine-readable format.
- Objection — object to processing based on legitimate interests.
- Withdraw consent — at any time, without affecting prior lawful processing.
- Complain — lodge a complaint with your national supervisory authority. We ask that you contact us first so we can try to resolve the matter directly.
10.2 Rights under the CCPA/CPRA (California residents)
- The right to know what personal information we collect, use, disclose and retain.
- The right to delete personal information, subject to statutory exceptions.
- The right to correct inaccurate personal information.
- The right to opt out of the sale or sharing of personal information. We do not sell or share personal information as those terms are defined by the CPRA, and we have not done so in the preceding twelve months.
- The right to limit the use of sensitive personal information. We do not collect it.
- The right not to receive discriminatory treatment for exercising any of these rights.
10.3 Exercising your rights
Send your request to contact@vortixglobaldynamics.com or write to the registered office address below. We will acknowledge within 10 business days and respond substantively within 30 days, or within 45 days for California requests where an extension is permitted and we notify you of it. We will verify your identity before acting on a request; an authorised agent must provide written proof of authority. Exercising these rights is free of charge unless a request is manifestly unfounded or excessive.
11. International transfers
We are established in the United States and our infrastructure is operated primarily in United States cloud regions. If you contact us from outside the United States, your information will be transferred to and processed there. Where we transfer personal data from the EEA, the United Kingdom or Switzerland, we rely on the European Commission’s Standard Contractual Clauses (and the UK International Data Transfer Addendum where applicable), supplemented by the technical measures described in Section 9. A copy of the relevant transfer mechanism is available on request.
12. Children’s privacy
Our services are directed exclusively at businesses and are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children. If we learn that we have inadvertently done so, we will delete it promptly. A parent or guardian who believes we hold such information should contact us at contact@vortixglobaldynamics.com.
13. Changes to this policy
We review this policy at least annually and whenever our processing activities change materially. The “Last updated” date at the top of this page always reflects the current version. Where a change materially affects your rights — including any change to how mobile information is handled — we will provide advance notice by email to the address we hold for you, and where required by law we will obtain fresh consent.
